Indian court issues notice to Shah Rukh Khan, Gauri in baby AbRam’s sex determination case

The Bombay High Court has issued a notice to Bollywood actor Shah Rukh Khan and wife Gauri in a case filed by social activist Varsha Deshpande asking for Mumbai’s Municipal Corporation inquiry report into sex determination allegations against the couple, reports Indian newswire PTI.

AbRam, born through surrogacy on May 27, was a premature baby. The controversy around sex determination made rounds in the media even before he was born. Shah Rukh had denied any such activity via an official statement in July and later told media at a conference that ‘sex determination is redundant’.

The High Court’s site has listed the criminal writ petition number 4164 for hearing on January 10.

Justice R. P Sondurbaldota has also issued notices to Jaslok Hospital, Dr. Farija Parikh and the Municiapl Corporation in the case.

Deshpande has challenged a lower court order before the High Court that refused her application for action against the Khan’s under the Pre-conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act.

Deshpande sought copies of the surrogacy documents and inquiry report from the Municipal Corporation that was initiated after her complaint. The civic body had given a clean chit to the Khans, saying no offence had been committed.

“The magistrate rejected our application seeking production and verification of documents following which we approached the High Court,” Deshpande’s lawyer Uday Warunjikar told PTI.
