A Mumbai court rejected a social activist’s application on Tuesday seeking to help prosecution and intervene in the 2002 hit-and-run case involving Bollywood actor Salman Khan, reported Indian news wire PTI.

The court held that only an aggrieved party, complainant or witness had a right to intervene. As activist Santosh Daundkar was neither a witness, complainant nor aggrieved party, his application could not be allowed.

Daundkar also asked the court to transfer his perjury plea against Khan and police to a higher court alleging wrong witnesses before the court delayed the trial. This plea was rejected by the court as it does not have the jurisdiction to transfer the complaint.

Meanwhile Khan’s application asking the court to direct media to report true and fair proceedings in the 2002 hit-and-run case has been deferred to October 15 as the High Court is already looking into the matter.

Khan had already approached the High Court with a defamation and civil suit against some media for alleged incorrect reporting of the case proceedings.

The High Court then issued an interim direction asking media to report objectively in the case involving the Bollywood star.

“His Honour Judge Mr. D. W. Deshpande pronounced the orders in open court wherein he dismissed/rejected the Intervention Application of Mr. Santosh Daundkar i.e. ‘Exhibit 4’ and the Miscellaneous Application No. 212 of 2013 filed by Mr. Santosh Daundkar for transfer of Miscellaneous Application No. 479 of 2012, pending before the Learned Additional Chief Metropolitan Magistrate’s 9th Court, Bandra, to the Hon’ble Court of Sessions,” said a blog entry on Khan’s website ‘salmankhanfiles.com’ dedicated to his court cases.

“The application filed by me (Khan) i.e. ‘Exhibit 8’ seeking appropriate directions / guidelines with regard to the manner in which this case should be reported by the media i.e. factual reporting, is kept pending and in the meantime, the interim order dated July 24, 2013 passed by His Honour Judge Mr. U. B. Hejib shall continue,” the post stated regarding the High Court order.
