Wife’s expanding waistline not sufficient ground for divorce, court tells husband

A man in India cannot divorce his wife because of her sudden weight gain since their marriage, the Bombay High Court has ruled, according to Britain’s Daily Telegraph.

The unnamed couple married in 2000 after meeting through a Hindu marriage bureau in Pune, the British news publication reported. But after the wedding ceremony, the wife started gaining weight dramatically, alarming her husband.

The petitioner claims he asked her to seek medical treatment for her condition, which she refused, resulting in arguments over the issue.

The man later discovered his wife had undergone surgery before marriage, which was causing the weight gain, according to the Daily Telegraph. He felt deceived because she hadn’t disclosed her condition before they married.

According to the husband, they didn’t enjoy the normal physical pleasures of married life because of her size and condition, the Daily Telegraph reported.

“Due to overweight respondent had black skin near sex organ and signs of injury. I was shocked to see the physical condition of respondent and could not perform sexual relations with her voluntarily,” the husband told the court.

However, under cross examination, he admitted his wife “initiated for sexual relations” and that he “also demanded sex from respondent [his wife].”

Based on the fact the couple still enjoyed a normal sexual relationship, the judges rejected the husband’s divorce petition.
